Mandatory Arbitration & Class Action Waiver

You and MetalWealthNow Media LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Site shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you and MetalWealthNow Media LLC each waive any right to a jury trial and any right to participate in a class action.

The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. A single arbitrator — a retired judge or experienced attorney — shall preside. MetalWealthNow Media LLC will pay all AAA filing, administration, and arbitrator fees for claims that are not frivolous.

Any claim must be filed within one (1) year after the date the cause of action arose, or it is permanently barred.

Opt-Out: You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending written notice to: MetalWealthNow Media LLC, 1 Financial Plaza, Suite 500, New York, NY 10005, with the subject line "Arbitration Opt-Out." If you opt out, all other provisions of these Terms remain in effect.
